
The Supreme Court of Nigeria has ruled that the All Progressives Congress (APC) does not have a candidate for Yala 1 State Constituency in next month’s election in Cross River State.
The Supreme Court on Monday, in a unanimous decision, held that the APC primary election that produced Regina Anyogo as the candidate of the APC is illegal and invalid having been held in Ogoja, outside the Yala 1 State constituency.
According to First Baba Isa, counsel to the appellant, Victoria Otanya Odey, the Supreme Court dismissed the appeals filed by both APC and Regina Anyogo for being an academic exercise.
The Federal High Court sitting in Calabar and presided over by Justice Ijeoma Ojukwu had dismissed the Mrs. Odey’s suit which sought, amongst others, the nullification of the primaries that produced Honorable Regina Anyogo as the candidate of the All Progressives Congress, APC for the Yala 1 State constituency in the 2023 general elections.
The prayer of Mrs. Odey to be declared the APC candidate for the constituency was rejected.
The Supreme stated that the implication is that APC has no candidate for Yala 1 State Constituency in the 2023 General Elections.
Honourable Justice Amina Augie, JSC, who delivered the lead judgment, advised that all parties should learn from this and conduct their affairs respectably next time.
